Terms & Conditions

These terms and conditions apply to goods and services supplied to you – including your use of www.allcook.live (“our Website”) – by us, Digiters (“us”, “we”, “our”). Allcook.live is an innovative concept and brand owned by Alexandra Thorey, who leases it to Digiters free of charge on temporary bases till January 2021.

You should read, and ensure persons that you book into a cooking class are aware of and read, these Terms & Conditions carefully before requesting our goods and services (e.g. booking a cooking class, or buying a voucher) as they set out your rights and the conditions on which we make those goods and services available to you. By requesting or using our goods and services, or otherwise indicating your consent, you agree to be bound by these Terms & Conditions.

You should also read, and ensure persons that you book into a cooking class are aware of and read, our Privacy and Cookies Policy (to find out what kind of information we collect about you, how we use and safeguard such information and your rights and choices in relation to this), Terms for Competitions (if you are entering into a competition/prize promotion – these will also be available on our promotional posts about that competition/prize promotion), our Terms for Contributions if you are submitting content to us (e.g. as part of a competition/prize promotion), and any other terms that we notify you apply at the time such as terms and conditions applicable to offers and promotions. We reserve the right to cancel offers or promotions at any time and they are always subject to availability. If you have any questions, please get in touch with us as described below under the ‘Contact us’ heading.

 By booking a cookery class with allcook.live, you agree that:

1. You have permission to act on another person’s behalf when you provide their personal information to us, and register them for a cooking class, and that you and any other persons registered for the cooking class have read and understood our Privacy Policy.
2. You will arrive at least 5 minutes ahead of the scheduled start time of your class, No refunds will be given to late arrivals as per our cancellation and rescheduling policy below.
3. You alone are responsible to ensure ingredients you purchase before an online cooking class are suitable for your own health needs, and safely transported, stored and (if applicable) prepared.
4. Following your class, you will follow all our instructions for the preparation, transportation, storage, reheating, cooking and consumption of meals.
5. You will indemnify and hold us and our employees harmless from all claims, damages, liabilities and causes of action which may arise as a result of:
   1. your preparation, storage, re-heating and consumption of food after your class;
   2. any injuries or damages you sustain or, or that your guest or anyone affiliated with or connected with you, may sustain in connection with or resulting directly or indirectly from your or your guest’s, or affiliated or connected person’s, involvement in our cooking classes.
6. Our liability to you shall not exceed the total price charged for any classes you have paid for.
7. If you purchased the course for a child of 6 years old and older you are personally responsible for his or her security and health and have to be present during the entire course and make sure that your child is safe using kitchen utensils, equipment and ingredients.
8. Teenagers of 16 years and older can participate in any course for adults. During Adult courses alcohol such as wine or beer may be consumed. Spirits may not be consumed. By accepting these terms and conditions you agree that your child might see adults consuming alcohol.
9. Any participant in a cooking class is welcome to send another person in their place as long as you inform us by calling or emailing us (as described below under the ‘Contact us’ heading) at least 1 business day prior to the class of that person’s name, allergies, dietary requirements and any other special requirements (for example, access needs), and that person has read and consented to these Terms and Conditions and our Privacy Policy.
10. If you book an online cooking class, we will send an ingredients list, equipment list and preparation guidelines to the email address you provide at the time of booking. It is your responsibility to pay for and ensure you have the ingredients and equipment required to participate in the online cooking class. We are not liable to provide any refunds, exchanges, reschedule an online class, pay for the cost of ingredients or equipment, or liable in any other way to you if you are unable to fulfil those requirements.
11. If you book an online cooking class, it is your responsibility to ensure you have the technical capability (such as software and internet speed) to attend that class. We are not liable to provide any refunds, exchanges, reschedule an online class, provide technical support, or liable in any other way to you if you are unable to attend or participate fully in an online cooking class due to any technical issues.

 

Bookings and cancellations for group classes by individuals:

1. If you need to cancel or reschedule a booking you must do this by emailing us (at the email address below under the ‘Contact us’ heading) at least 7 days before the date of your class and you will be given a full refund for the cooking class. We are sorry that we will be unable to refund or reschedule a cooking class with less than 7 days’ notice. If you give less than 7 days’ notice to cancel (or you were late and therefore unable to join your cooking class as per our policy described at paragraph 2 above). 
2. Once you have purchased the participation in the group class you may invite people to join you for cooking at your place and connect from the same device. However if you would like to invite someone to join from another device the additional participation has to be purchased. 

Bookings and cancellations for private events

1. Private events pricing depends on the time, amount of participants and difficulty of the recipe and type of the course. Pricing may vary. 
2. Payment in full is required at the time of booking. Payment may be made via credit/debit card, bank transfer, PayPal. 
3. If you need to cancel or reschedule a booking you must do this by emailing us (at the email address below under the ‘Contact us’ heading) at least 7 days before the date of your class and you will be given a full refund for the cooking class. We are sorry that we will be unable to refund or reschedule a cooking class with less than 7 days’ notice. If you give less than 7 days’ notice to cancel (or you were late and therefore unable to join your cooking class as per our policy described at paragraph 2 above). 
4. Reduction of the number of participants will not influence the agreed price
5. You may request to increase the number of participants by contacting us by email or phone at least 7 days prior to the booking date, in which case we will do our best to accommodate you, however any increase to the class size is entirely at our discretion. In the event that we agree to increase the number of participants, you must pay the additional cost per participant immediately. 
6. Final numbers and dietary requirements for your class must be confirmed no later than 7 weeks prior to the start time of the cookery class in order to give us enough time to suggest the replacements

Alcohol and food allergy policy

1. During a course for adults, chefs as well as guests may consume alcohol such as beer, cider or wine. Spirits may not be consumed during the course. If you have kids younger than the legal age of alcohol consumption in the majority of European states (16 years old) present during the course their exposure to consumption of alcohol drinks is under your responsibility as their legal representative.
2. Ingredients may contain or have been manufactured/prepared on shared equipment with wheat, dairy, eggs, nuts, fish, soya and shellfish and other allergens.
3. The exhaustive list of ingredients is provided to you while you book the class. If you are allergic to any type of food, you must ensure yourself that the products you purchase for the course doesn’t contain allergens you or your guests are allergic to
4. You alone are responsible, and we accept no responsibility, for ensuring that allergy and dietary requirements are looked after for anyone who consumes any food you purchase for our cooking class

Gift cards terms and conditions

1. The gift voucher will expire 6 months from the date of purchase. Please keep your receipt as proof of purchase in case of any queries. We cannot accept responsibility for lost or stolen voucher codes.
2. The gift voucher may not be exchanged for cash.
3. To redeem a voucher, send a note to info@allcook.live
4. You may cancel a voucher within 14 days of purchasing it by contacting us (see ‘Contact us’ below) in accordance with your statutory rights. You can but don’t have to use the cancellation form below. Provided you have contacted us within 14 days of purchasing your voucher, we will refund you the value of the voucher that has not yet been used to book a class and, if you have used some or all of the voucher to book a class, we may only refund you for the value of that booked class as per our above mentioned cancellation terms. The refund will be paid to your original payment method within 14 days after you inform us of that cancellation.

Accuracy of information and availability of our Website

While we try to make sure that our Website is accurate, up-to-date, free from bugs and always available for you to use without any interruptions, we can’t promise that it always will be. We also can’t promise that our Website will be fit or suitable for any purpose. If you rely on any of the information on our Website, it’s at your own risk. While we hope never to do so, we can suspend or terminate operation of the Site at any time as we see fit.   

Our content (including content provided to you in our cooking classes and on our Website) is provided for your enjoyment only and to inform you about our, and our affiliate’s, products, news, features, services and other websites that may be of interest. None of it is nutritional, technical, financial or legal advice or any other type of advice and you shouldn’t rely on it for any purposes.

Our Website may contain hyperlinks or references to third party websites. These hyperlinks or references are provided for your convenience only; we have no control over third party websites, accept no legal responsibility for any content or information contained in them, and a hyperlink or reference does not mean we are endorsing that third party’s website, products or services. If you use a third party website you are subject to the terms and conditions of that site. Each individual advertiser is solely responsible for the content of its advertising material on our Website. We accept no responsibility for individual advertisers’ content, including, without limitation, any error, omission or inaccuracy.

Our Website gives you the option to sign-up to our newsletters about allcook.live. You can decide not to receive these emails at any time by clicking the ‘Unsubscribe’ option at the bottom of our emails. Disputes

If you have any complaints or issues please contact us by sending a message to info@allcook.live as soon as possible. Your concerns are important to us and we will try to resolve any disputes with you quickly and efficiently. If you and we cannot resolve a dispute using our complaint handling procedure, we will let you know that we cannot settle the dispute with you. If you want to resolve disputes in court, laws of Switzerland are applied while resolving any disputes. 

Breach of these terms

If you breach these Terms, then we may use your personal information to investigate the breach, or to share our concerns. We may issue you with a formal warning or we may prevent or suspend your access to our goods and services if you do not comply with any part of these Terms, or any terms or policies to which they refer to, or any applicable law.

Changes to these Terms

These Terms were last updated on 1st of September 2020. We may vary these Terms from time to time without advance notice. Our updated terms will be displayed on our Website and you agree to be bound by the updated version.

• provide feedback to us or complete a survey about allcook.live
• contact us, for example via the contact form on our Website, social media, phone, email or by letter
• sign up to receive any of our email newsletters and marketing
• enter any competitions or prize draws we run
• submit content to us, for example if you post a selfie and use one of our hashtags on your public social media account in response to one of our competitions

Sometimes we also obtain information about you from other sources, for example when you:

• purchase a gift card, cooking lesson or products on our Website – we receive information from our payment gateway Stripe, PayPal
• complete one of our surveys – we receive your answers and any personal information you provide within your answers from Survey Monkey, Google forms

Other companies might sell allcook.live-branded products or provide allcook.live related services under licence. Please make sure you always check the privacy policy of the websites you use so you know who runs the website and how they will use your personal information.

How long your personal information will be kept

We will keep your personal information while we are providing any services to you (including any marketing or newsletter services). Thereafter, we will keep your personal information for as long as is necessary:

• to respond to any questions, complaints or claims made by you or on your behalf
• to show that we treated you fairly
• to keep records required by law

We will not retain your personal information for longer than necessary for the purposes set out in this policy and we will delete or anonymise your personal information when it is no longer necessary to retain it. Transfer of your information outside the EEA

To deliver the Website and our Services to you, it is sometimes necessary for us to share your personal information outside the European Economic Area (EEA), eg:

• with your and our suppliers or service providers located outside the EEA
• if you are based outside the EEA

These transfers are subject to special rules under European and UK and Swiss data protection laws. Prior to permitting such transfers, we ensure all personal information transferred will be kept secure. Our standard practice is to use standard data protection model contract clauses that have been approved by the European Commission (as permitted under Article 46(2) of the General Data Protection Regulation) or to only transfer your data to companies that are registered with the Privacy Shield (for transfers to the USA). Keeping your personal information secure

We have appropriate security measures in place to prevent personal information from being used, destroyed, lost, altered, disclosed or accessed either accidentally or without authorisation. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner, where permitted by law and are subject to a duty of confidentiality. We continually test our systems to make sure the level of security matches any risk and we run regular security tests. Our data servers are located in Switzerland. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

Changes to this Privacy Policy

We may vary this Privacy Policy from time to time. When we do we will post the changes on the Website. Where the changes are significant, we will inform all our current customers or subscribers by email. Where required by law, will we obtain your consent to make these changes.
